In exchange for participation in the courses presented by ARC Tactical

and/or the use of the property, facilities and services of ARC

Tactical I, agree for myself and (if applicable) the members of my family , to the

following:

1. AGREEMENT TO FOLLOW DIRECTIONS.

I agree to observe and obey all posted rules and warnings, and further agree to follow any oral instruction or directions given by ARC Tactical or the employees, representatives or agents of ARC Tactical.

2. ASSUMPTION OF THE RISKS AND RELEASE.

I recognize that there are certaininherent risks associated with the above-described activity and I assume full responsibility for personal injury to myself and (if applicable) my family members, and further release and discharge ARC Tactical for injury, loss or damage arising our of my or my family’s use or or presence upon the facility of ARC Tactical, whether caused by the fault of myself, myself, ARC Tactical or other third parties.

3. INDEMNIFICATION.

I agree to indemnity and defend ARC Tactical against all claims, causes of action, damages, judgments, costs or expenses, including attorney fees and other litigation costs, which may in any way arise from my or my family ’s use of or presence upon the facilities or ARC Tactical.

4. PHOTOGRAPHY AND VIDEOGRAPHY.

I understand and agree that during the course of this event, digital photographs and or video may be taken and used for demonstration and marketing purposes only.

5. FEES.

I agree to pay for all damages to the facility and or equipment of ARC Tactical caused by any negligent, reckless or willful actions by me or my family.

6. APPLICABLE LAW.

Any legal or equitable claim that may arise from participation in the above activity shall be resolved under Washington Law.

7. NO DURESS.

I agree and acknowledge that I am under no pressure or duress to sign this Agreement and that I have been given a reasonable opportunity to review it before signing. I further agree and acknowledge that aim free to have my own legal counsel review this Agreement if I so desire. I further agree and of acknowledge that ARC Tactical has offered to refund any fees I have paid to use its facilities, training and or equipment if I choose not to sign this Agreement.

8. ARMS’S LENGTH AGREEMENT.

This Agreement and each of its terms are the product of an arm’s length negation between the Parties. In the event any ambiguity is found to exist in the interpretation of this Agreement, or any of its provisions, the Parties, and each of them, explicitly reject the application of any legal or equitable rule of interpretation which would lead to a construction either “for” or “against” a particular party based upon their status as the drafter or a specific term, language, or provision giving rise to such ambiguity.

9. ENFORCIBILITY.

The invalidity or unenforceability of any provision of this agreement, whether standing alone or as applied to a particular occurrence or circumstance, shall not affect the validity or enforceability or any other provision of this Agreement or of any other application of such provision, as the case may be, and such invalid or unenforceable provision shall be deemed not to be a part of this agreement.

10. INSTRUCTOR RESPONSIBILITY.

I understand that the materials and techniques presented by ARC Tactical are designed to be delivered and instructed exactly as presented. Certified instructors and their agencies assume all responsibility for materials and techniques delivered non ARC Tactical personnel. The materials are consistent with legal principles and best practices at the time the materials and techniques were delivered. ARC Tactical is not responsible for legal or best practice conflicts after the materials and techniques are presented.

11. COVID19 I understand that the nature of this training requires me to be in close contact with other students and instructors. I understand that because of COVID19 there are inherent risks even with advised precautions. I agree to accept these risks and maintain proper hygiene to mitigate the risks of COVID19.

The details of the activity have been described to me. I have read this document and

understand it. I further understand that by typing or signing this release, I voluntarily surrender certain legal rights.
